SPECIAL NOTICE REGARDING BINDING OF
DOCUMENTS
The Commission has implemented the Management Information
System (MIS) required under §26 ch 205 SLA 1999. The MIS
requires that all documents the Commission receives be
electronically scanned into the information management
system.
To facilitate the scanning process we request that entities who
file documents at the Commission not use staples, comb
binding, or other fasteners that pierce paper. Fasteners and
bindings of this type leave paper dust that interferes with the
scanner's operation.
Please attach your documents by using a paper clip, rubber
band, or other clasp. Please number the pages of every
document that is more than one page in length, with
numbering at the bottom of each page in consecutive Arabic
numerals, in the form "page x of y".
The Commission is amending 3 AAC 48.100(j) which describes
the general requirements of documents filed with the
Commission and has waived the application of that subsection
regarding the binding or fastening of documents to the extent
necessary for initiating the scanning process for the MIS.

FACSIMILE FILINGS (3 AAC 48.090)
Effective July 1, 2001, the Regulatory Commission of Alaska
discontinued the courtesy practice of accepting pleadings and
other documents by facsimile.
To comply with our regulations, pleadings and other documents
must be filed by mail or personal delivery. If, weather or other
conditions would prevent a timely filing other than by facsimile,
a party may submit a filing by facsimile with an accompanying
motion that describes the need for submitting the filing by that
method, including a description of how the party plans to
submit the original and multiple copies required under 3 AAC
48.090.
Our regulations provide in pertinent part:
3 AAC 48.090. FILING, SERVICE, AMENDMENT AND DISPOSITION OF
PLEADINGS.
(a) A document is considered filed with the commission on the date it
is received by the commission, or by a commissioner or a staff
member designated by the commission to receive papers,
correspondence, and filings. . .
(b) Unless otherwise directed by the commission, service of pleadings,
orders, and other documents is valid and complete if made by
delivering, in person or by mail,
(1) an original and 10 copies to the commission for each
document; . . .
(3) in addition to the copy requirements of (1) of this subsection,
in a multi-docketed proceeding, three copies to the commission
for each of the other dockets listed in the consolidated
proceedings to which the document pertains; . . .
ELECTRONIC FILINGS
Electronic filings are not accepted by the Commission, unless
submitted CD or diskette by mail or in person along with hard
copies and original, 3 aac 48.090 (b)
3 AAC 48.090 - FILING, SERVICE, AMENDMENT AND DISPOSITION OF
PLEADINGS
(a) A document is considered filed with the Commission on the date it
is received by the commission, or by a commissioner or a staff
member designated by the commission to receive papers,
correspondence, and filings . . .
(b) Unless otherwise directed by the commission, service of pleadings,
orders, and other documents is valid and complete if made by
delivering, in person or by mail,
(1) An original and 10 copies to the commission for each
document;
(2) One copy to each party, or to the party's attorney of record or
other authorized representative; and
(3) In addition to the copy requirements of (1) of this subsection,
in a multi-docketed proceeding, three copies to the commission
for each of the other dockets listed in the consolidated
proceedings to which the document pertains; and
(4) If possible, a 3.5-inch diskette or CD formatted in an IBM
compatible form using MS Word or in Adobe Acrobat (.PDF) format
and containing the text of the filing made to the commission; the
filer shall clearly label the diskette or CD with the filer's name,
docket number, type of pleading, date of submission, and file
name.
In other words, if you choose to submit a 3.5 inch diskette or
CD formatted electronic data, you MUST ALSO SUBMIT an
original and 10 copies to the Commission for each document on
the disk or CD.

Tariff Filing Requirements and New Processing Deadlines
New legislation passed during the recent legislative session sets
deadlines for processing cases.
The deadlines for tariff filings are as follows:

The Commission shall issue a final order not later that nine
months after a complete tariff filing is made for a tariff filing
that does not change the utility’s revenue requirement or rate
design.

The Commission shall issue a final order not later than 15
months after a complete tariff filing is made for a tariff filing
that changes the utility’s revenue requirement or rate design.
The deadlines for processing tariff filings begin from the time a
complete tariff filing is made. Generally, complete tariff filings
comply with the Commission’s regulations at 3 AAC 48.200 - 3
AAC 48.430, and Alaska Statutes at AS42.05.361 and
AS42.05.411 (AS42.06.350 and AS42.06.390 for pipeline
tariffs). Other form and filing requirements may apply for
specific circumstances.

All tariff filings will be reviewed for completeness. The
Commission will reject incomplete tariff filings with a letter
order explaining why the filing is not complete under
Commission regulations. The Chief of the Tariff Section has
been delegated authority to sign letter orders rejecting tariff
filings.
